Based on gthe Provision for Employee Inventions of Tokyo Medical and Dental Universityh, intellectual properties created by TMDU researchers belong in principle to the university.
When TMDU researchers invent something, they are required to submit an Invention Disclosure Form to Intellectual Property Division.
Intellectual Property Division staff conduct a hearing, survey and the like with the inventor, and the invention is then discussed at a Council for Invention Belonging (The council is composed of intellectual property managers, Intellectual Property Division staff and outside expert consultants.). At this council, Intellectual Property Division determines whether the right to the invention should be assigned to the university or not.
Intellectual Property Division works with the inventor to file a patent application for the invention that was decided to be assigned to the university.
An invention that is not assigned to the university is considered to belong to the individual and returned to the researcher.
In principle, Research Materials created at TMDU belong to TMDU, and should be managed properly by the researchers.
When a Research Material is provided to an outside institution, or is provided by an outside institution, TMDU researchers notify to Intellectual Property Division. In order to make sure to conclude a reasonable agreement, Intellectual Property Division examines terms and conditions of the agreement.
